Limited Warranty Conditions

This limited warranty (“Limited Warranty”) shall apply only to the product described below (the “Product”) and shall only be effective if the attached Warranty Registration Card is completed and returned to Safe-Point Healthcare Limited (“SPH”).

SPH warrants that the Product is at the time of its original purchase free of defects in materials and workmanship.  

This Limited Warranty is subject to the following terms and conditions:

  1. This Limited Warranty is given only to the original purchaser of the Product named below (the “Customer”). It shall neither exclude nor limit any statutory rights of the Customer or any of the Customer’s rights against the seller/dealer of the Product.
  2. This Limited Warranty shall last for twelve (12) months from the date of original purchase (the “Warranty Period”).  PROOF OF PURCHASE WILL BE REQUIRED.
  3. This Limited Warranty may not be sold on, assigned, transferred or given to any subsequent purchaser or acquirer of the Product. This Limited Warranty is only valid and enforceable by those Customers who have purchased the Product in the United Kingdom.
  4. Throughout the Warranty Period SPH or its authorised service agent will at its discretion without charge and subject to Clause 6 repair or replace a defective Product. SPH will return the repaired Product or a replacement Product to the Customer in good working condition. All replaced faulty parts or components will become the property of SPH.
  5. If SPH repairs or replaces the Product, the repaired or replaced Product shall continue to be warranted for the remaining time of the original Warranty Period.
  6. THIS LIMITED WARRANTY SHALL NOT APPLY:

    6.1 - to any plastic surfaces or to any other externally exposed parts that are scratched or damaged in the course of the Customer’s normal use of the Product;

    6.2 - to Safe-Point sharps bins;

    6.3 - if the Customer Service Department of SPH or its authorised service agent was not notified by the Customer of the defect within fourteen (14) days after the appearance of the defect within the Warranty Period;

    6.4 - if the Product was not returned to SPH or its authorised service agent within thirty (30) days after the appearance of the defect within the Warranty Period;

    6.5 - where the defect is caused by:

    6.5.1 - deterioration due to  normal wear and tear; or

    6.5.2 - use other than in accordance with the Operating Instructions, rough handling, improper storage, improper installation, exposure to moisture, dampness or extreme thermal or environmental conditions or a rapid change in such conditions, corrosion, oxidation, unauthorised modifications or connections, unauthorised opening or repair, or repair by use of unauthorised spare parts, neglect, abuse, accident, forces of nature, or other actions beyond the reasonable control of SPH (including but not limited to deficiencies in consumable parts, such as fuses, which by their nature have a limited lifetime) unless the defect was caused directly by defects in materials or workmanship; or

    6.5.3 - failure of a mains electricity supply; or

    6.5.4 - operation of the Product outside published maximum ratings; or

    6.5.5 - the use of inappropriate needles or sheaths;

    6.6 - if the serial number or the IMEI number of the Product has been removed, erased, defaced, altered or is illegible.

  7. In the event of Product failure:

    7.1 - the Customer should:

    7.1.1 - refer to the Operating Instructions in order to identify and possibly correct the problem;

    7.1.2 - if the problem cannot be resolved by reference to the Operating Instructions, contact [insert contact details] on [insert telephone number], ensuring that it has the following information to hand:

    7.1.2.1 - the model number, serial number and IMEI number of the Product;

    7.1.2.2 - the Customer’s full address and post code; and

    7.1.2.3 - a copy of the Customers original invoice, receipt or bill of sale of the purchase of the Product.

    7.2 - SPH will subject to the Customer’s compliance with its obligations in clause 7.1:

    7.2.1 - provide the Customer with instructions regarding how and when the defective Product should be returned; and

    7.2.2 - pay all costs in connection with both the return of the defective product to SPH and of the repaired Product or replacement product back to the Customer.

  8. THIS LIMITED WARRANTY SETS OUT THE ENTIRE WARRANTY GIVEN BY SPH TO THE CUSTOMER. ALL IMPLIED WARRANTIES OF SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE DURATION OF THE RELEVANT WARRANTY PERIOD. IN NO EVENT SHALL SPH BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR COMMERCIAL LOSS, TO THE FULLEST EXTENT THAT THOSE LOSSES OR DAMAGES CAN BE EXCLUDED BY LAW.

SPH does not exclude or limit liability for personal injury or death resulting from its own negligence OR THAT of its servants or agents.

Some countries do not allow the exclusion or limitation of incidental or consequential loss or damage, or limitation of the duration of implied warranties, in those circumstances the preceding limitations or exclusions may not apply to such Customers. This Limited Warranty gives the Customer specific legal rights but the Customer may also have other rights which may vary from country to country. This Limited Warranty does not affect the Customer’s statutory rights in law specific to the country of purchase and such rights remain protected.
